DS2 Agency builds and operates automation and sales-support software for small and medium-sized businesses. In these terms, "we" and "us" mean DS2 Agency; "you" means the person using one of our applications; "client" means the business that engaged us to operate the application your account belongs to.
Our Privacy Policy forms part of these terms and explains how we handle personal data. Where a signed service agreement exists between DS2 Agency and a client, that agreement prevails over these terms for that client.
Use the applications for the business purpose they were built for, and nothing else. In particular, do not:

The Gioel Leads app can connect to your own Google Account so you can see your availability and save appointments while you work. This connection is optional and the rest of the app works without it.

Section 4 of our Privacy Policy describes in full what we access, what we store, and our Limited Use commitment under the Google API Services User Data Policy.
Our sales applications hold contact data — names, phone numbers, addresses, notes about calls and appointments. That data belongs to the client whose team you work in. The client decides why it is processed and is the data controller; DS2 Agency processes it on the client's instructions, as described in the Privacy Policy.
If you upload a contact list, an address book, or a customer file, you confirm that you and the client have the right to process that data and to have us process it on their behalf. Do not upload special categories of personal data (health, political opinions, and the other categories listed in GDPR Art. 9) into our applications — except through the Gesigroup claims portal, covered separately in 6a below.
The Gesigroup claims portal at ds2.studio/gesigroup is the one exception to the rule above: uploading identity documents and health/medical records is the specific, intended purpose of that portal, not something to avoid. Gesigroup is the data controller for everything you enter or upload there; DS2 Agency processes it on Gesigroup's instructions, operating the portal on Gesigroup's behalf. If you are a Gesigroup client, only upload documents that relate to your own claim and that you have the right to share. Section 5d of our Privacy Policy describes in full what is collected, why, and the legal basis for processing it.
We aim to keep the applications available and working, but we do not promise uninterrupted service unless a separate agreement with the client says otherwise. The applications depend on third-party platforms — Supabase, Netlify, n8n, Google, Meta — and an outage at any of them can interrupt features that rely on it.
We add, change, and remove features as the products evolve. Where a change removes something you rely on, we will tell the client in advance whenever it is reasonable to do so. Maintenance may cause short interruptions.
The applications, their source code, design, and documentation belong to DS2 Agency. Nothing in these terms transfers ownership of the software to you or to the client; you receive a limited, non-exclusive, non-transferable right to use the applications for the duration of the engagement.
The data entered into the applications belongs to the client. On request we provide an export of it, and we delete it in line with the retention rules in the Privacy Policy.
The applications are provided "as is". To the extent permitted by law, we make no warranty that they will be error-free, that any particular result will be achieved, or that they are fit for a purpose we have not agreed in writing. The features that display calendar availability, suggest contacts, or compute statistics are decision aids, not guarantees — check anything that matters before acting on it.
To the extent permitted by applicable law:
We may suspend or close an account that breaches these terms, that poses a security risk, or where the client's engagement has ended. You can stop using the applications at any time; the client can ask us to close their accounts and delete their data, and we will do so in line with the Privacy Policy.
Disconnecting the Google Calendar connection does not close your account, and closing your account deletes the Google tokens we hold for you.
We may update these terms when the products or the legal requirements change. The "Last updated" date at the top of this page always reflects the current version, and material changes are communicated to the client. Continuing to use the applications after a change takes effect means you accept the updated terms.
These terms are governed by the law of the Federal Republic of Germany, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Where the client is a business, the courts competent for the seat of DS2 Agency have jurisdiction. Mandatory consumer protection rules of your country of residence remain unaffected.
